Terms of Service

1. Agreement to Terms
These Terms of Service (the “Terms”) are a binding agreement between you and Avion, an individual developer based in the United States (“we,” “us,” or “the Company”). By installing, accessing, or using the Avion iOS application (the “Service”), you agree to be bound by these Terms. If you do not agree, do not use the Service.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
2. Description of the Service
Avion is a circadian rhythm scheduling tool. Based on the sleep profile and flight itinerary you provide, the Service generates a personalized schedule of recommended sleep windows, light exposure, light avoidance, melatonin timing, caffeine cutoff, and meal timing intended to reduce jet lag.
Avion is informational and educational. It is not a medical device, does not diagnose or treat any condition, and is not a substitute for professional medical advice.
3. Subscriptions and Billing
Subscription model.The Service offers an optional auto-renewing subscription (“Avion Pro”) sold through the Apple App Store. A free tier is also available with limited functionality. Pricing is shown in the app at the time of purchase and varies by Apple Account region.
Free trial. New subscribers may be eligible for a free trial. Apple determines eligibility based on Apple Account history; once a free trial has been used in a subscription group, the user is no longer eligible for another trial in that group on the same account.
Auto-renewal. Your subscription automatically renews at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your Apple Account is charged at the price shown in the app at the start of each renewal period.
How to cancel. You can manage or cancel your subscription at any time through your Apple ID account settings: Settings → Apple Account → Subscriptions, or through the Manage Subscription option in the Service. Cancellation takes effect at the end of the current paid period — you retain access until then.
Refunds. Apple processes all subscription refunds. We do not have the ability to issue refunds directly. To request a refund, visit reportaproblem.apple.com or contact Apple Support. Refund decisions are at Apple's discretion under its terms.
Price changes.If we change the subscription price, Apple will notify you and request your consent before the next renewal as required by Apple's terms. You may cancel before the change takes effect to avoid the new price.
Family Sharing.Where supported, the subscription may be shared with your Apple Family Sharing group, subject to Apple's Family Sharing rules and the subscription's configuration in the App Store.
4. Not a Medical or Emergency Service
Avion is not a medical provider. The Service does not provide medical advice, diagnosis, or treatment. All recommendations are for informational and educational purposes only.
No emergency monitoring. The Company does not monitor your data, schedule, or notification activity. The Service is not an emergency response system.
Consult a healthcare provider. If you have a sleep disorder, shift work disorder, take medication that affects sleep, are pregnant, or have any other medical concern, consult a healthcare provider before following any recommendation. Never rely on the Service as a substitute for professional medical care.
Supplement guidance. Melatonin and caffeine timing recommendations are informational only. Consult a healthcare professional before starting, stopping, or changing any supplement regimen.
Travel safety first. Do not follow a recommendation if it would conflict with safe travel — for example, staying alert while driving, operating equipment, or supervising others. Use caffeine and light cues as guidance, not commands.
5. Account and Eligibility
Eligibility: You must be at least 16 years of age to use the Service.
Account responsibility: You are responsible for maintaining the confidentiality of your account and for all activity under your account. Notify us immediately of any unauthorized use.
Accurate information: You agree to provide accurate sleep and trip information. Inaccurate inputs will produce inaccurate schedules.
6. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or disassemble any part of the Service.
- Upload or transmit viruses, malicious code, or any content that disrupts the Service.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Use the Service for any unlawful purpose or in violation of these Terms.
- Resell, rebrand, or redistribute the Service without our written permission.
7. Third-Party Services and Apple Standard EULA
The Service relies on third-party services including Apple Sign In with Apple, Apple App Store, Apple Push Notification Service (used only for premium flight alerts in Avion Pro), RevenueCat, and Amazon Web Services. Standard schedule reminders are delivered via local notifications on-device and do not go through APNs. Your use of those third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.
Apple Standard EULA.If you obtained the Service through the Apple App Store and have not agreed to a separate end-user license, your use of the Service is also governed by Apple's Licensed Application End User License Agreement (the “Apple EULA”), available at apple.com/legal/internet-services/itunes/dev/stdeula. To the extent any conflict exists between these Terms and the Apple EULA, these Terms control with respect to your relationship with us, and the Apple EULA controls with respect to your relationship with Apple.
Apple as third-party beneficiary.You acknowledge that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Maintenance and support. We are solely responsible for providing any maintenance and support services for the Service. Apple has no obligation to furnish maintenance and support services for the Service.
Product warranty. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Service to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Service. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure of the Service to conform to any warranty shall be solely our responsibility.
Product claims. We are responsible for addressing any claims you or any third party have relating to the Service, including (a) product liability claims, (b) any claim that the Service fails to conform to any applicable legal or regulatory requirement, and (c) claims arising under consumer protection, privacy, or similar legislation. Apple is not responsible for addressing such claims.
Intellectual property infringement.In the event of any third-party claim that the Service or your possession and use of the Service infringes that third party's intellectual property rights, we will be solely responsible for the investigation, defense, settlement, and discharge of any such claim. Apple is not responsible.
Legal compliance.You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Intellectual Property
The Service, including its content, features, circadian algorithms, schedule generation logic, design, and branding, are the exclusive property of the Company and its licensors. You may not reproduce, distribute, modify, or create derivative works of any part of the Service without our written permission.
Nothing in these Terms grants you rights to use the Avion name, logo, or branding beyond what is necessary to describe your use of the Service.
9. Disclaimer of Warranties
The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied. We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free.
- The Service will function correctly on all devices or iOS versions.
- Following the generated schedule will eliminate jet lag, reduce fatigue, or produce any specific health outcome.
- Push notifications will be delivered successfully or in a timely manner.
- Third-party services used by the Service will remain available.
Individual responses to circadian interventions vary. The Service's recommendations are based on population-level research and may not be optimal for every individual.
10. Limitation of Liability
To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to:
- Loss of profits, data, productivity, or use.
- Personal injury or health consequences resulting from following or not following a recommendation.
- Missed flights, missed events, or other consequences of inaccurate schedule timing.
- Loss of sleep or fatigue resulting from any recommendation.
- Reliance on the accuracy of any schedule recommendation.
In no event shall the Company's total liability exceed the amount you paid to use the Service in the twelve (12) months preceding the claim, or one hundred U.S. dollars ($100), whichever is greater.
11. Indemnification
You agree to defend, indemnify, and hold harmless the Company and its agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party right.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason including breach of these Terms. Upon termination, your right to use the Service ceases immediately.
You may terminate your use of the Service at any time by deleting your account directly in the app (Profile → Delete Account) or by uninstalling the app. You may also request deletion at privacy@avionapp.com.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
14. Limitation of Actions
Any claim arising out of or relating to these Terms or the Service must be filed within one (1) year after the claim arose; otherwise, the claim is permanently barred, to the maximum extent permitted by applicable law.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall remain in full force and effect.
16. Changes to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted within the app with a revised “Last Updated” date, and material changes will be announced in the app's release notes. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
