Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Anthony Sgro, an individual developer based in the United States (“we,” “us,” or “the developer”). By downloading or using the Avion Shift app (the “App”), you agree to be bound by these Terms. If you do not agree, do not install or use the App.

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Avion Shift is an iOS app that generates personalized jet lag management schedules based on your flight information. It provides recommendations for sleep timing, light exposure, meal windows, and supplement timing to help shift your circadian rhythm.

Avion Shift is a wellness tool, not a medical device. It does not provide medical advice, diagnosis, or treatment. The schedules it generates are general guidance based on circadian rhythm research and are not a substitute for professional medical care.

Avion Shift does not provide medical advice, diagnosis, or treatment. All recommendations are for general wellness and informational purposes only. Always consult a qualified healthcare provider before making changes to your sleep schedule, taking supplements such as melatonin, or if you have any medical conditions that may be affected by changes in sleep or light exposure.

Avion Shift is not an emergency service. We do not monitor your health or activity. If you are experiencing a medical emergency, contact emergency services (911 or your local equivalent) immediately.

The App should never be relied upon as a substitute for professional medical care.

Eligibility: You must be at least 13 years of age to use the App.

Account security: You are responsible for maintaining the security of your account credentials. We are not liable for any loss or damage arising from unauthorized access to your account.

Account deletion: You may delete your account and all associated data at any time directly within the App. Deletion is immediate and permanent.

You are solely responsible for how you use the App. You agree not to use Avion Shift to:

• Violate any applicable local, national, or international law
• Reverse engineer, decompile, or disassemble the App or any part of it
• Attempt to gain unauthorized access to any part of the App or its backend infrastructure
• Engage in harassment, stalking, impersonation, or any activity that harms another person
• Upload or transmit viruses, malware, or any other malicious code
• Use the App in any way that could damage, disable, or impair our servers or networks

The App communicates with third-party services to provide certain features. These services include Sentry (crash reporting) and AWS Cognito (authentication). Reminders are delivered as local notifications on your device — they do not go through Apple Push Notification Service. Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service. The specific data sent to each service is described in our Privacy Policy.

The Avion Shift name, logo, and associated branding are the property of the developer. All rights reserved. Nothing in these Terms grants you rights to use the Avion Shift name or branding beyond what is necessary to describe your use of the App.

The App is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied. We do not warrant that:

• The App will function correctly on all devices or iOS versions
• The schedules generated will be effective for every individual — jet lag responses vary between people
• The App will be free from bugs, errors, or interruptions
• Third-party services used by the App (including flight data) will be accurate or available at all times
• Notifications will be delivered successfully or on time

To the maximum extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to:

• Any health outcome resulting from following the App's recommendations
• Loss of data caused by device failure, app deletion, or other circumstances
• Inaccurate flight data provided by third-party services
• Failure of notifications to deliver in time
• Legal consequences resulting from your use of the App in violation of these Terms

In no event shall the developer's total liability exceed the amount paid by you, if any, for the App (which is free).

You agree to indemnify and hold harmless the developer from and against any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App or your violation of these Terms.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately. You may also delete your account at any time within the App.

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

Any claim arising out of or relating to these Terms or the App must be filed within one (1) year after the claim arose; otherwise, the claim is permanently barred, to the maximum extent permitted by applicable law.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall remain in full force and effect.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date, and material changes will be announced in the App's release notes. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
